Save the Fraser Declaration - Alberta and Northwest Territories First Nations join BC First Nations in opposing Enbridge Pipeline and Tankers Proposal

On January 30th, media, First Nations groups, activists and one law student intern crowded into a hotel room on the outskirts of Edmonton for a press conference held by the Yinka Dene Alliance. Alberta and Northwest Territories First Nations signed on to the historic “Save the Fraser Declaration” to oppose the export of tar sands oil to tankers on the BC Coast. As a law student intern newly started at West Coast Environmental Law, I was very interested to watch First Nations asserting their decisions under Indigenous law.

The Canadian government recently withdrew suddenly and unexpectedly from a funding agreement to create a plan to manage BC’s North Coast, known as the Pacific North Coast Integrated Marine Area Plan (PNCIMA). Prime Minister Harper’s government may have believed that it was helping Enbridge and its Northern Gateway Pipelines by withdrawing from this funding agreement - but the resulting uncertainty, and the appearance that the federal government has acted less than honourably towards the Coastal First Nations, may well cause Enbridge huge legal head-aches in the future.

On December 2nd 61 First Nations with territory in the Fraser River watershed spoke up against Enbridge’s proposed Northern Gateway Pipeline – the Save the Fraser Gathering of Nations Declaration.  The same day the Nations published a full page ad in the Globe and Mail.

According to Barbara Yaffe’s most recent column in the Vancouver Sun, “Knocking oilsands bolsters Northern Gateway”, the actions of environmental groups, in exposing the environmental impacts of the Alberta tar sands, are making it more ‘imperative’ that Enbridge’s Northern Gateway Project proceed as the U.S. becomes increasingly unwilling to buy tar sands oil.

Coastal First Nation youth speak out on oil tankers

The BP spill in the Gulf of Mexico and the Enbridge Pipeline spill into the Kalamazoo River in Michigan have both brought international attention to the dangers of transporting oil over long distances.  Here in BC that’s meant increased scrutiny of Enbridge’s Northern Gateway pipeline and the possibility of oil tankers travelling the province’s treacherous north coast and a sullied reputation for Enbridge.

There is nothing but bleak news in the massive oil spill in the Gulf of Mexico currently destroying livelihoods and the environment in Florida, Mississippi, Alabama, Louisiana and possibly beyond.  There are reports circulating that that spill could quickly become much worse – and we must hope that these scenarios do not materialize and that the well is quickly capped.  Our thoughts are with ecosystems, as well as with the communities and livelihoods, that are being devastated.&n
